Why divorcing couples might want to consider simplified dissolution

While it may sound hard to believe, not every married couple heading for a divorce is warring with one another. Indeed, many times spouses -- whether they've been married for a few decades or a few years -- come to the realization that it's simply time to move on, and are able to part ways with little to no residual bitterness.   

Questions naturally arise then as to what divorce options are available to those couples whose interests lie in moving forward with a new chapter of their lives, not engaging in contentious or prolonged divorce proceedings.

Here in Florida, the answer might come in the form of what is known as simplified dissolution of marriage, which enables married couples to secure a divorce relatively quickly provided they fill out and file certain forms, and are able to satisfy certain requirements.

These requirements include:

  • Both spouses want to utilize simplified dissolution, and agree that the marriage is irretrievably broken.
  • One spouse has resided in Florida for the previous six months.
  • The couple do not have biological children under 18, adopted children under 18 or dependent children
  • Neither spouse is pregnant.
  • Neither spouse is seeking alimony.
  • All property division matters have been settled.

It's important for couples to know that failure to satisfy even one of these conditions will mean simplified dissolution is not an option. However, this doesn't mean that they are somehow prevented from securing an amicable, efficient and timely divorce, as there are a host of viable options, including uncontested divorce.
